Terms & Conditions


SUMMARY

By using the Contact Box service the user agrees to the following Terms & Conditions of service.

  1. The User agrees to provide true and accurate information about themselves in the registration set-up.
  2. The User agrees that they will not use the Service for any illegal purpose, or for the transmission of information that is libellous, unlawful, harassing, abusive, threatening, abusive of another’s privacy, harmful, vulgar, defamatory, obscene, pornographic, or in anyway that may infringe the laws governing, but not exhaustively covering, copyright, intellectual property rights, trademarks, pornography, or any other material that is slanderous, defamatory or might cause offence in anyway.
  3. The User agrees that they will not engage in any action that might be considered system abuse, these include but are not limited to

Attempting to circumvent user authentication or security of any host, network, or account on Contact Box’s systems or the Internet at large

  • Attempting, in anyway, to interfere with or deny service to any user or host on the Internet
  • Forging e-mail or USENET posting header information
  • Any form of relaying messages through Contact Box
  • Sending any unsolicited messages (i.e. ‘junk mail); this includes adding or attempting to add addresses to any mailing list without the express consent of the addressee
  • Forwarding or posting ‘chain letters’ of any type
  • Posting inappropriate messages to USENET newsgroups e.g. posting large numbers of unsolicited posts indiscriminately (‘spamming’)
  • Attempting to cancel, supersede, or otherwise interfere with e-mail or USENET posts
  • Using a Contact Box account or network connection to collect replies to messages sent from another provider which violate the rules of that other provider
  1. The User agrees that Contact Box and/or its designees may at any time, at their sole discretion, terminate the user’s account if they believe that the user has in anyway violated the ‘Terms & Conditions’ herein

ACKNOWLEDGEMENT & ACCEPTANCE OF TERMS OF SERVICE

The Contact Box Service is owned and operated by Contact Box Ltd, and is provided to the User under the ‘Terms & Conditions’ herein. Contact Box may at any time modify the ‘Terms & Conditions’ without any prior notice. The ‘Terms & Conditions’ and the User’s registration information are the complete agreement between the user and Contact Box regarding this service, and supersede any other prior agreements or communications between Contact Box and the User.

DESCRIPTION OF SERVICE

The service provides the User with the capability to send and retrieve electronic mail via the Internet on the Contact Box system. In addition it provides the user with the capability to route and forward calls on a number which can be allocated to the User, and to enable the User to receive fax, and voice messages into an e-mail account set up for this purpose.

The services provided by Contact Box change regularly. Please refer to www.contactbox.co.uk for updated products and services.

CONDITIONS OF USE

The User agrees to the following specific conditions of use apply:

  1. Access to the Internet service will only be given if the User provides caller ID information. The user will not be able to use the service if they dial 141 before the dial in number or have CLI barred. This measure is designed to prevent abuse of the network and sending unsolicited e-mail or ‘spam’
  2. Uploads to the user’s web space will be limited to 25Mb. More space may be made available on request for which a charge may be made
  3. Contact Box will not permit FTP access to the User’s web space or POP3 access to your e-mail from outside the Contact Box network. Further more direct SMTP connections from outside the Contact Box network will be barred.
  4. Where in the first full calendar month of use, or any subsequent full calendar month, the User has not received more than 5 minutes (for 070 numbers) or 19 minutes (0870 numbers) of calls (minimum use) to your allocated personal follow me number, Contact Box will 14 days after the end of the month in which the minimum use was not achieved take back the allocated number. Any number(s) taken back and associated password and PIN numbers will be made available for other users.
  5. If the User does not use their e-mail account for 90 days Contact Box will deactivate and remove your account, including e-mail addresses and web space from the service, together with any associated follow me personal numbers. All user names, passwords, numbers. Logins, and PIN number shall then be available to other users.
  6. If the User chooses the option for fax and voice messages to be stored on the Contact Box server as well as being forwarded to the User’s email, there is a limit of 30 messages that can be stored on the Contact Box server.

USER’S SET-UP OBLIGATIONS

To use the service the user must be registered on the Contact Box service.

MODIFICATIONS TO SERVICE

Contact Box reserves the right to amend, modify, change, or discontinue temporarily or permanently any service at its sole discretion without any notice to the user. The User also agrees that Contact Box shall not be liable to the User or any third party for any modification, or discontinuation of any service.

PRIVACY POLICY

Contact Box considers any e-mail, calls, faxes or messages sent via the Service to be private correspondence between the sender and recipient. Contact Box shall not monitor, edit, or disclose the contents of any communication, except that Users agree that Contact Box may do so: (a) as required by law (b) to comply with legal process (c) to conform to the limitations of the service, or (d) to conform to other, similar technical requirements.

The User acknowledges and agrees that Contact Box does not endorse the content of the User’s communications, and cannot be held responsible for any communications accessed, distributed or received by the user via the Service. Contact Box is not responsible or liable for any unlawful, harassing, libellous, privacy invading, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material, or content that infringes or may infringe the intellectual property or rights of another.

Contact Box reserves the right to send email to its users concerning Contact Box products, which Contact Box deems, may be of interest to them.

USER ACCOUNT, PIN NUMBER , PASSWORD & SECURITY

When using the service the User has sole responsibility for maintaining the security and confidentiality of all passwords, user names, PIN numbers or security access codes. The user accepts total responsibility for these codes and for any consequence of these codes being divulged.

USER CONDUCT

The user agrees that they will not engage in any action that might be considered system abuse, these include but are not limited to

  • Attempting to circumvent user authentication or security of any host, network, or account on Contact Box’s systems or the Internet at large
  • Attempting, in anyway, to interfere with or deny service to any user or host on the Internet

Using a Contact Box account or network connection to collect replies to messages sent from another provider which violate the rules of that other provider

USER RESPONSIBILITIES

The User accepts responsibility for the following;

  • To obtain, install and maintain suitable equipment and software to utilise the Contact Box services may available.
  • To obtain all necessary permissions to use the Service, to receive, download, display, distribute or execute other programs or perform other works.
  • To comply with applicable laws, regulations, or conventions including those related to data privacy, telecommunications, and use of technical or personal data.

INDEMNITY

The User agrees to indemnify and hold Contact Box and its parent, subsidiaries, affiliates, officers and employees from any claim or demand, including any made by a third party, arising out of the user’s use of the Service. The User agrees not to hold Contact Box and its parent, subsidiaries, affiliates, officers and employees responsible for any direct or indirect damage resulting from the use of the Service, in particular, but not limited to; the use or impossibility to use the Service, confidence in information obtained through the Service, errors and omissions, defects, viruses, delay in transmission, interruption of service or loss of data.

Further Contact Box disclaims, and the User agrees, any responsibility for the performance of its messaging, or telephone services, and any other Internet sites accessible through the Contact Box service.

NO RESALE OF SERVICE

The User agrees not to resell any part of the service offered by Contact Box, without Contact Box’s express permission in writing.

EMAIL STORAGE

It is the User’s sole responsibility to read and erase messages sent through the Contact Box service. Contact Box cannot be held responsible for the saturation of its servers. The User has sole responsibility to back up any messages received. Contact Box may at its sole discretion establish a revised upper limit of message storage without any notice.

TERMINATION

Contact Box may terminate the User’s account or some of the services offered to the user if

  • The User has violated the ‘Terms & Conditions’ set out here.
  • The User has violated the rights of other users.
  • If the User’s does not use the internet Service for any period of 90 days.
  • If the call minutes received in a full calendar month to the User’s personal number are less than 5 minutes (for 070 numbers) or 19 minutes (for 0870 numbers.)

The User acknowledges that any termination of an account or services under any provision of these ‘Terms & Conditions’ may be affected without prior notice, and that Contact Box may then immediately erase any messages linked to the user’s account, and bar access to the user’s account.

LINKS

The Service may provide links to other Internet, sites, resources or services. The User acknowledges that Contact Box is not responsible for any such external links. The User agrees that Contact Box shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use or reliance on any such content, goods or services available of such external sites or resources.

MAINTENANCE

The Service may be stopped or suspended for maintenance. No indemnity can arise from such events.

CONTACT BOX’S PROPRIETARY RIGHTS

The User acknowledges that the content, including but not limited to text, software, graphics, images, music, sound, logos, video or any other material containing in Contact Box’s site and services, or those of any advertiser, or sponsor, are protected by copyrights, trademarks, patents, service marks and other proprietary rights in law. The User may not copy, distribute, reproduce, or transmit such works, information or content without express authorisation.

DISCLAIMER OF WARRANTIES

The User expressly agrees the use of the Service is at their sole risk. Contact Box expressly disclaims all warranties of any kind whether express or implied, including but not limited to, the implied warranties of merchantability, fitness for purpose and non-infringement.

Contact Box makes no warranty the services will meet the user’s requirements, or that the services will be uninterrupted, timely, secure, or error free; nor does Contact Box make any warranty as to the results that may be obtained through the service or that defects in the software or systems may be corrected.

The User understands and agrees that any material and/or data downloaded or otherwise obtained through the use of this Service is done at the User’s sole discretion and risk and that the User will be solely responsible for any damage to their computer system or loss of data that results from the download of such data or material.

No advice or information, whether oral or written which was obtained from Contact Box or through the Service shall create any warranty not expressly made herein.

LIMITATION OF LIABILITY

Contact Box shall not be liable for any indirect, incidental, special or consequential damages or for interrupted communications, lost data, or loss of profits arising out of or in connection with these ‘Terms & Conditions’.

NOTICE

Any notice to the User or to the Service shall me made by e-mail or regular mail. Contact Box may also provide notice of changes on the Service.

GENERAL

These ‘Terms & Conditions’ will be governed and construed in English law. If any of the provisions of these ‘Terms & Conditions’ is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Contact Box’s failure to act with respect to a breach by users does not waive its right to act with respect to subsequent or similar breaches.

The ‘Terms & Conditions’ sets forth the entire understanding and agreement between the User and Contact Box.

All registration requests are subject to review and approval by Contact Box staff. Contact Box reserves the right to refuse service to anyone it chooses.
